How can we help you?

If you or a passenger in your vehicle have been hurt in a motor vehicle accident then you should seek legal advice to help guide you through the process of claiming for damages.

Sinnamon Lawyers specialty division Motor Accident Legal Service acts on a no win no fee basis in all claims in which we represent clients and we pay for the costs of outlays including medical reports throughout your claim.

This type of claim is a Compulsory Third Party Claim or a CTP Claim as it is more commonly known.

Motor vehicle accident injuries

If you have been injured in a motor vehicle accident you should promptly seek legal advice as strict time limits are imposed upon personal injuries claims. Your right to damages can be lost if you do no act within the required time limit.

It is important that you seek medical attention following an accident. Under the claims process we can assist you by getting your medical expenses paid by the Insurer. This includes the cost of physiotherapy and other rehabilitation treatments including such things as chiropractic treatment, occupational therapy, hydrotherapy, dental treatment or surgery that may be required following a motor vehicle accident.

It is recommended that an expert assists you throughout the claims process as Insurers will not pay you your full entitlement in the event that you deal with them directly. We can provide sound advice about the types of compensation that are available to you.

We assist our clients in all accidents involving vehicles including car accidents, motorbike and bicycle accidents, truck accidents, boat accidents and accidents involving vehicles and pedestrians.

Damages

Sinnamon Lawyers specialty division Motor Accident Legal Service has vast experience in claiming the following types of damages following motor vehicle accidents:

  • General Damages: an amount for pain and suffering
  • Special Damages: medical and out of pocket expenses (including rehabilitation expenses)
  • Lost Income: any amount you have lost in wages or business income as a result of the injuries you have suffered.
  • Care and assistance: In certain cases we can recover damages for the care and assistance provided to you by friends and relatives.

You can still claim damages even if you are receiving or have received WorkCover benefits following an accident.

Who can claim compensation?

Any person involved in a motor vehicle accident in which another person is at fault can claim compensation under the CTP system. This includes drivers of a vehicle not at fault, passengers in any vehicle involved in a collision and pedestrians. Parents can make claims on behalf of their children. We have also acted for many cyclists and motor bike riders who often come off second best following a collision with a vehicle.

Will my claim affect the driver of the vehicle at fault?

No. All drivers of registered vehicles are covered by Compulsory Third Party Insurance and any compensation paid to you is paid by the Insurer, not the driver at fault.

In cases involving unregistered vehicles the Nominal Defendant steps in and pays compensation although it may seek recovery against the driver of the unregistered vehicle. Even motorists who are over the legal alcohol limit are covered although the Insurer may seek a recovery from the drunk driver in respect to any compensation paid.

Types of Injuries

Sinnamon Lawyers specialty division Motor Accident Legal Service will assist you in relation to any injury suffered following a motor vehicle accident from whiplash injuries (which can be particularly debilitating to the sufferers of those injuries) to catastrophic injuries such as those involving paraplegia, quadriplegia or brain injuries.

We work closely with a team of professionals including specialist doctors and therapists from whom we obtain medical reports and in certain cases barristers so as to ensure your claim is properly assessed and you receive the maximum compensation available under the Compensation System.

We are very happy to talk to anyone involved in a motor vehicle accident in an obligation free consultation and will take on your case, no win no fee, should you decide to appoint us as your legal representatives.

No win no fee – what does this mean?

For you, no win no fee means that if we are unsuccessful then you pay us nothing at all. You pay nothing in respect to our time or our fees and you pay nothing in respect of our outlays meaning medical report fees etc. Naturally we assess your claim at the outset however if we take it on then it is at no risk to you in terms of any costs payable to us.

When we win your file is forwarded to an independent costs assessor who will independently determine the costs that have been incurred to ensure fairness in the billing process by the inclusion of an independent third party.

You can contact us on 1800 060 891 to discuss your situation obligation free or complete the attached enquiry form and we will contact you without delay and if you can’t come to us, we can come to you.

How long will my claim take?

Many claims can be settled between 12 – 18 months of the date of the accident. More serious injuries can take longer to recover and this can lead to a longer claims process. Having said that we handle all claims as quickly as possible but not at the expense of settling a claim without obtaining the best medical evidence to maximise your compensation entitlements.

TPD Claims

Please also feel free to ask us about assistance in making a Total Permanent Disability Claim under your Superannuation Policy if you have been injured. Your entitlements should be available even if you are at fault for the incident.
